Life Story Insurance (dba FC Insurance) Terms & Conditions of Use

“Site,” or “App”), operated by Life Story Insurance Agency, LLC (“Life Story
Insurance,” “FC Insurance”, “we,” “us,” or “our”). These
Terms & Conditions of Use (the “Terms”) govern your access to and use of the Site and the services
available through it (collectively, the “Services”).
By accessing or using the Site or Services, you agree to be bound by these Terms. You
represent and warrant that you are at least 18 years of age. If you do not agree to these Terms, in whole or in
part, do not use the Site or Services.
We reserve the right to update these Terms at any time. Please check this page
periodically, as your continued use of the Site or Services constitutes acceptance of any revised terms.

2. User Conduct
By using this Site, you agree not to engage in any of the following activities:
- Violating any law or regulation.

Your sole and exclusive remedy for dissatisfaction is to discontinue use of the

You agree to defend, indemnify, and hold harmless Life Story Insurance and its
officers, directors, employees, and affiliates from any claims, liabilities, damages, or expenses (including legal
fees) arising from:
- Your use or misuse of the Site or Services.
- Your violation of these Terms.
- Your infringement of any third-party rights.
10. Termination
We reserve the right to terminate your access to the Site or Services at any time, with
or without cause or notice. We may also modify, suspend, or discontinue the Site or any portion thereof at our
discretion.
11. Miscellaneous
- If any provision of these Terms is deemed unenforceable, the
remainder shall remain valid and enforceable.
- These Terms are governed by the laws of the State of Texas, without
regard to conflict-of-law rules.
- You agree that any dispute shall be resolved exclusively in the state
or federal courts located in Dallas County, Texas.
- These Terms constitute the entire agreement between you and Life
Story Insurance and supersede any prior agreements regarding the subject matter.
- No waiver of any term shall be deemed a further or continuing waiver
of any other term.
12. LEGAL DISPUTES

YOU AND FIDELITY LIFE AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY OR TO
PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE
IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, ALSO MAY BE UNAVAILABLE OR LIMITED IN ARBITRATION.

Any dispute between you and Fidelity Life its agents, employees, officers, directors, principals, successors,
assigns, subsidiaries or affiliates (collectively for purposes of this section, “Fidelity Life”) arising from or
relating to these Terms of Use and their interpretation or the breach, termination or validity thereof, the
relationships which result from these Terms of Use, including disputes about the validity, scope or
enforceability of this arbitration provision (collectively, “Covered Disputes”) will be settled by binding
arbitration. Prior to initiating any arbitration, the initiating party will give the other party at least
60-days’ advanced written notice of its intent to file for arbitration. Fidelity Life will provide such notice
by email to your e-mail address on file with Fidelity Life and you must provide such notice by email to
legalfidelity@fidelitylife.com.
Any Covered Disputes you have arising out of or relating to these Terms of Use shall be resolved by a single
impartial arbitrator pursuant to proceedings administered by the American Arbitration Association under its
rules for resolution of commercial disputes. Any such Claim shall be brought solely by you as an individual and
not as part of, or as a representative of, a class. You and we agree that any arbitration you initiate, you will
pay the fees (ie., filing, hearing, hearing room, abeyance) and you and us will split the arbitrator’s
compensation and expenses. For any arbitration initiated by us, we will pay the fees (ie., filing, hearing,
hearing room, abeyance) and you and us will split the arbitrator’s compensation and expenses. The arbitration
shall be held in Chicago, IL. All submissions to the arbitrator, the proceedings and the award shall be
confidential. The arbitration shall be conducted on an expedited basis with minimal discovery. The arbitrator’s
award shall be final and binding. The courts of the State of Illinois and/or the United States District Court
for the Northern District of Illinois shall have exclusive jurisdiction and venue over (i) any action concerning
the enforcement of an arbitration award, or (ii) if arbitration is not permitted by law, then any Claim you have
arising out of or relating to these Terms of Use. You agree to unconditionally and irrevocably submit to the
exclusive jurisdiction and venue of such courts and you will not object to such jurisdiction and venue on the
grounds of lack of personal jurisdiction, inconvenient forum or otherwise. EACH PARTY IRREVOCABLY WAIVES ANY AND
ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OF USE. Fidelity
Life reserves all rights and remedies available to it, in law or equity, with respect to any matter relating to
these Terms of Use.
Neither party consents or agrees to any arbitration on a class or representative basis, and the arbitrator shall
have no authority to proceed with an arbitration on a class or representative basis. No arbitration will be
consolidated with any other arbitration proceeding without the consent of all parties. Any claim or controversy
as to the enforceability of this arbitration provision’s restriction on your right to participate in or pursue a
class action or classwide arbitration shall be brought only in the United States District Court for the Northern
District of Illinois or any State of court located in Cook County, Illinois.
If any portion of this section is found to be unenforceable or unlawful for any reason, (a) the unenforceable or
unlawful provision shall be severed from these Terms of Use; (b) severance of the unenforceable or unlawful
provision shall have no impact whatsoever on the remainder of this section or the parties’ ability to compel
arbitration of any remaining claims on an individual basis pursuant to this section; and (c) to the extent that
any claims must therefore proceed on a class, collective, consolidated, or representative basis, such claims
must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that
litigation of those claims shall be stayed pending the outcome of any individual claims in arbitration. Further,
if any part of this section is found to prohibit an individual claim seeking public injunctive relief, that
provision will have no effect to the extent such relief is allowed to be sought out of arbitration, and the
remainder of this section will be enforceable.”
GOVERNING LAW These Terms of Use and all matters regarding your use of the Site shall be governed by, construed
in accordance with, and enforced under the laws of the State of applicable to contracts made and executed and
wholly performed in the State of Illinois, without regard to choice of law principles. Neither the Uniform
Computer Information Transaction Act nor the United Nations Convention on Contracts for International Sale of
Goods apply and their applicability is expressly excluded. Printed copies of any and all agreements and/or
notices in electronic form shall be admissible in any legal, investigative or regulatory proceedings.
